A RESOLUTION of the Board of Directors of Bainbridge Island School District No. 303, Kitsap County, Washington, providing for the submission to the qualified electors of the district at a special election to be held therein on February 9, 2021, of the proposition of whether excess taxes should be levied of $10,000,000 in 2021 for collection in 2022, $10,300,000 in 2022 for collection in 2023, and $10,500,000 in 2023 for collection in 2024, said excess taxes to pay for educational enrichment programs and operations support of the district.

RESOLUTION NO. 03-20-21

A RESOLUTION of the Board of Directors of Bainbridge Island School District No. 303, Kitsap County, Washington, providing for the submission to the qualified electors of the District at a special election to be held therein on February 9, 2021, of the proposition of whether excess taxes should be levied of $10,000,000 in 2021 for collection in 2022, $10,300,000 in 2022 for collection in 2023, and $10,500,000 in 2023 for collection in 2024, said excess taxes to pay for educational enrichment programs and operations support of the District.

WHEREAS, Bainbridge Island School District No. 303, Kitsap County, Washington (the “District”), was previously authorized to collect a four-year educational program and operations levy in order to enable the District to pay for its educational program and operations, including teaching, instructional support, school supplies, extracurricular activities and transportation; and

WHEREAS, the current educational program and operations levy expires in 2021; and

WHEREAS, in 2017 the Washington State Legislature passed, and in 2019 amended, the Basic Education Funding Act (Laws of 2017, 3d Spec. Sess., ch. 13) which makes changes to education funding in the state, including re-designating maintenance and operations levies as “enrichment levies,” placing limits on levied amounts and directing the deposit of taxes levied commencing in 2021 to a sub-fund of the General Fund; and

WHEREAS, the money in and to be paid into the General Fund of the District during the 2021-2022, 2022-2023, 2023-2024 and 2024-2025 school years will be insufficient to enable the District to pay for necessary educational enrichment programs and operations and to properly meet the educational needs of the students attending District schools; and

WHEREAS, in order to properly provide for such educational enrichment programs and operations support, the Board of Directors of the District deems it necessary to renew the expiring levy by levying taxes upon all of the taxable property within the District in excess of the maximum annual tax levy permitted by law to be levied within the District without a vote of the electors, such levy to be made for three years commencing in 2021 for collection in the school years from 2021-2022 through 2024-2025, inclusive, as authorized by Article VII, Section 2 of the State Constitution and RCW 84.52.053; and

WHEREAS, the question of whether or not such excess tax may be levied must be submitted to the qualified electors of the District for their ratification or rejection; and

WHEREAS, the conditions here and above set forth requires the holding of a special election in the District;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF BAINBRIDGE ISLAND SCHOOL DISTRICT NO. 303, KITSAP COUNTY, WASHINGTON, as follows:

Section 1. The following taxes for the District’s General Fund should be levied upon all of the taxable property within the District in excess of the maximum annual tax levy permitted by law to be levied within the District without a vote of the electors:

A. $10,000,000, said levy to be made in 2021 for collection in 2022;

B. $10,300,000, said levy to be made in 2022 for collection in 2023; and

C. $10,500,000, said levy to be made in 2023 for collection in 2024.

The exact levy rate and the actual amounts to be collected shall be adjusted based upon (1) the actual assessed value of the property within the District at the time of the levy and (2) the legal limit on the levy rate and levy amount applicable at the time of the levy. At this time, based upon information provided by the Kitsap County Assessor’s office, the estimated levy rate for the 2021 levy is $1.04 per thousand dollars of assessed valuation, the estimated levy rate for the 2022 levy is $1.06 per thousand dollars of assessed valuation, and the estimated levy rate for the 2023 levy is $1.07 per thousand dollars of assessed valuation.

Upon approval by the voters of the proposition substantially in the form set forth below, the District may use the proceeds of said levies during the 2021-2022, 2022-2023, 2023-2024 and 2024-2025 school years, may incur an indebtedness by the issuance of short term obligations against the General Fund of the District, as authorized by Chapter 39.50 RCW, and may expend the proceeds of said levies to pay for eligible activities in accordance with the Basic Education Funding Act, as it may be amended and supplemented, and other applicable law.

Section 2. It is hereby found and declared that the best interests of the District require the submission to the qualified electors of the District of the proposition of whether or not the District shall levy such excess tax for their ratification or rejection at a special election to be held therein on February 9, 2021.

The Kitsap County Auditor, as ex officio supervisor of elections in Kitsap County, Washington, is hereby requested to call and conduct said special election to be held by all mail-in ballot within the District on said date and to submit to the qualified electors of the District the proposition substantially in the form hereinafter set forth.

The Secretary of the Board of Directors is hereby authorized and directed to certify said proposition to the Kitsap County Auditor, as ex officio supervisor of elections in Kitsap County, substantially in the following form:

The Secretary of the Board of Directors of the District is hereby authorized and directed to: (a) present a certified copy of this resolution to the Kitsap County Auditor, (b) approve changes to the ballot title, if any, deemed necessary by the Kitsap County Auditor or the Kitsap County Prosecuting Attorney, and (c) perform such other duties as are necessary or required by law to submit the proposition to the voters. All actions of the District or its staff or officers taken prior to the effective date of this resolution and consistent with the objectives and terms of this resolution are ratified and confirmed.
